Recover unpaid overtime, final wages, and stolen tips

  1. Gather your employment and pay records
    45 min

This step produces one folder — physical or digital — and a one-page inventory of what you have and what is missing. The inventory is the load-bearing part: it shows which weeks you can prove from records and which weeks you will have to prove some other way. Records live in five places, so collect first and sort after: the payroll portal and email for pay stubs and the W-2 or 1099; scheduling apps and screenshots for shifts; texts and messages about hours, pay, and tips; and bank statements, whose deposits and card timestamps become time evidence when the schedule is gone.
