Do I need a trademark attorney, or can I file this myself?

You do not need a lawyer to follow it. But the guide is not for everyone — if you face an active opposition, a conflicting registration that would need a consent agreement, or a complex multinational filing, it says those situations warrant professional counsel.

How do I know my trademark isn’t already taken before I pay the filing fee?

Before any filing, the guide has you run a clearance search: identical marks in the USPTO database, confusingly similar marks in related classes, and common-law sources for unregistered use. You then evaluate the likelihood of confusion and decide whether to proceed. This phase comes before the filing steps, so you can stop before spending the TEAS Plus fee if the search turns up a problem.

I’m not selling under my brand yet — can I still register it?

Yes. The guide covers the intent-to-use filing basis for marks you have a bona fide intent to use in the near future, alongside the use-in-commerce basis for marks already in use. If you file on an intent-to-use basis, the final phase covers filing your Statement of Use after a Notice of Allowance.

What happens if the USPTO questions or rejects my application?

The last phase of the guide covers prosecution: confirming receipt and monitoring status through TSDR, responding to any office action within the three-month deadline, and tracking publication in the Official Gazette and the opposition window. If a dispute escalates into a contested opposition proceeding, that is outside this guide’s scope — the guide names it as a situation that warrants professional counsel.

Can I register a logo, or only a wordmark?

Both. The first phase covers choosing between a standard character mark for the word itself and a special form mark for a logo or stylized design, so you register whichever fits your brand. The specimen phase then shows you how to capture the mark as it actually appears in commerce.
