Break a lease early without owing the rest of the year

Your legal exit route identified — statutory (SCRA, domestic violence, uninhabitability, job relocation clauses), contractual buyout, assignment, or sublet — notice served exactly as the statute requires, the landlord's duty to mitigate documented and applied, and a written release signed with the security deposit settled before you hand back the keys.

Who it's for

Tenants locked into a lease who must move mid-term for a job transfer, a breakup, a safety issue, or a unit the landlord will not repair — and who want to pay the least they legally owe instead of the full remaining rent.

About this playbook

This guide walks you through the only three ways out of a mid-lease move: a statutory termination right, a negotiated buyout, or a handoff to another tenant. You first map your lease and your state's law to find the path you qualify for, then assemble the evidence that path demands. You serve notice exactly as the statute requires, negotiate the smallest amount you legally owe, and close with a written release before the keys change hands. It covers the SCRA, domestic-violence termination statutes, uninhabitable-unit claims, assignment and sublet, and the duty-to-mitigate rule that caps your damages in most states. It does not cover eviction defense, rent disputes, or legal representation, and it gives you a process and templates, not guarantees — your state's statutes control.

What you need first

A signed copy of the lease, a firm move-out date, and the reason you are leaving: military orders, a protective order or police report, a written repair history, or an employer's transfer letter. Access to your state's landlord-tenant statutes. For service members, official orders or a commanding officer's letter; for uninhabitability claims, a record of repair requests already sent.
